Welcome to Promethio! These terms and conditions (the “Terms”) govern your use of our mobile app and website (the “Platform”). By using our Platform, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use our Platform.

To use our Platform, you must be at least 18 years of age. By using our Platform, you represent and warrant that you are 18 years of age or older. If you are under 18 years of age, you may not use our Platform.

We make no representations or warranties of any kind, express or implied, as to the operation of our Platform or the information, content, materials, or products included on it. We do not warrant that our Platform will be uninterrupted or error-free.

In no event shall Promethio be liable for any damages of any kind arising from the use of our Platform, including, but not limited to, direct, indirect, incidental, punitive, and consequential damages.

You agree to indemnify and hold Promethio and its affiliates, officers, agents, and employees harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your use of our Platform, your violation of these Terms, or your violation of the rights of any third party.

These Terms and your use of our Platform shall be governed by and construed in accordance with the laws of the State of North Carolina, without giving effect to any principles of conflicts of law.

Any dispute arising out of or in connection with these Terms or the use of our Platform shall be resolved through binding arbitration in accordance with the commercial arbitration rules of the American Arbitration Association. The arbitration shall be conducted in Raleigh, North Carolina.

These Terms constitute the entire agreement between you and Promethio and govern your use of our Platform. If any provision of these Terms is found to be invalid or unenforceable, that provision shall be enforced to the maximum extent possible, and the remaining provisions shall remain in full force and effect.
